How to Dispute Temporary Water Diversion Licences (TDLs)

An oil and gas company will apply to AER (Alberta Energy Regulator) for a Temporary Water Diversion Licence (TDL) for the use of surface water and/or groundwater.

TDL applications are found on the AER Public Notice of Application website at webapps.aer.ca/pnoa

You have to check the website every 30 days, as companies can reapply every 30 days for a TDL.

To search for TDL’s, you are required to have the legal land description.

Once you have found the TDL application, there often is very little information. To see information about volumes of water being used, you must request a copy of the application from the applying company using the contact information on the AER website.

You can file a statement of concern to the AER within a 30-day period about how that project will directly and adversely affect you or other people in the area, as well as on fish-bearing streams.

The AER will then review and approve, deny, or approve with conditions the application.

You must have documented information to show adverse effects before the AER can cancel the licence.
